Definitions

  • Goods: movable items, including goods packaged in limited quantities or defined volumes in containers, bottles, sachets, boxes, or otherwise.
  • Parties: collectively, the Seller and the Buyer.
  • Consumer: a natural person acting outside the scope of their profession, independent occupation, or business activity.
  • Consumer Contract: a contract where one party qualifies as a consumer.
  • Manufacturer: the producer of the product; in the case of imported goods, the importer bringing the product into the European Union, as well as any person or entity presenting themselves as the manufacturer by marking their name, trademark, or other distinguishing feature on the product.
  • Website: this website, including the online store used for concluding contracts.
  • Contract: a sales agreement concluded between the Seller and the Buyer via the Website and electronic communications.
  • Durable Medium: any device that allows the consumer or business to store data addressed to them in a way accessible for future reference for a period corresponding to the purpose of the data, and to reproduce the stored data unchanged.
  • Means of Distance Communication: any device suitable for making contractual statements in the absence of the parties to conclude a contract. Such devices include, in particular, addressed or unaddressed forms, standard letters, order forms in press advertisements, catalogs, telephone, fax, and devices providing internet access.
  • Distance Contract: a consumer contract concluded without the simultaneous physical presence of the parties, using only means of distance communication within a remote sales system organized for providing the product or service.
  • Product: goods offered for sale on the Website.
  • Business: a person acting within the scope of their profession, independent occupation, or business activity.
  • Seller/Company: a legal entity selling goods (as importer, manufacturer, or other lawful acquirer) via the online store operating on the Website.

Buyer: the person concluding a contract by making a purchase offer through the Website.

Warranty: in the case of contracts concluded between a consumer and a business (hereinafter: consumer contract), the warranty under the Civil Code for the proper performance of the contract, which the business undertakes voluntarily beyond its statutory obligation or in the absence of such obligation.

Purchase Price: the consideration payable for the goods.

Scope and Acceptance of the General Terms and Conditions (GTC)

The content of the contract concluded between the parties – alongside mandatory provisions of applicable law – is determined by these General Terms and Conditions (hereinafter: GTC). Accordingly, the GTC sets out the rights and obligations of the parties, the conditions for concluding the contract, performance deadlines, delivery and payment terms, liability rules, and the conditions for exercising the right of withdrawal.

Any technical information necessary for the use of the Website not included in these GTC is provided through other information available on the Website. The Buyer is obliged to read and accept the provisions of these GTC and the data management policy before finalizing their order.

Contract Language and Form

The language of contracts governed by these GTC is Hungarian. An electronic contract concluded through the online store is not considered a written contract; therefore, it is not registered in paper form and will not be available later in printed format. However, the content of the contract can be reconstructed from the electronic confirmation emails sent to the Buyer. We maintain a record of orders, which is kept for at least 5 years from the date of the last entry.

Prices

The prices indicated next to the products are in Hungarian Forints (HUF) and include 27% VAT. In the shopping cart, the gross prices of products (including 27% VAT) are displayed. These prices include packaging costs, but not shipping. The Seller may adjust prices for business reasons. Price changes do not apply to orders that have already been confirmed. If the Seller has listed an incorrect price and an order is placed for the product but not yet confirmed, no consumer contract is created, and the Seller will proceed according to the “Procedure for Incorrect Pricing” section of the GTC.

Procedure for Incorrect Pricing

The following are considered obviously incorrect prices:

  • A price of 0 HUF
  • A price with a mistakenly applied discount (e.g., a product listed at 1000 HUF with a 20% discount incorrectly applied and offered at 500 HUF)

In case of an incorrect price, the Seller will offer the product for purchase at the correct price. The Buyer may then decide whether to order the product at the correct price or cancel the order without any negative consequences.

Consumer Protection Procedure

Complaints may also be submitted to the consumer protection authorities. If a consumer believes their rights have been violated, they are entitled to file a complaint with the consumer protection authority competent for their place of residence. After reviewing the complaint, the authority decides whether to initiate a consumer protection procedure. First-instance consumer protection authority duties are performed by the county and metropolitan government offices responsible for the consumer’s place of residence. Judicial Proceedings

The customer is entitled to enforce any claims arising from a consumer dispute before a court under civil proceedings, in accordance with Act V of 2013 on the Civil Code and Act CXXX of 2016 on the Code of Civil Procedure, with the stipulation that the dispute will be settled before the Hajdúböszörmény District Court.


Conciliation Board Proceedings

We inform the Buyer that they may submit a consumer complaint against us. If the Buyer’s consumer complaint is rejected, they are entitled to turn to the Conciliation Board competent for their place of residence or stay. Initiating conciliation proceedings requires that the consumer first attempts to resolve the dispute directly with the business. Upon the consumer’s request, the competent conciliation board may be the one indicated by the consumer rather than the default authority.

The business has an obligation to cooperate in conciliation proceedings.

This includes the duty to respond in writing to requests from the conciliation board, as well as the obligation to appear before the board, ensuring the participation of a person authorized to conclude an agreement at the hearing.

If the business’s registered office or site is not located in the county where the competent conciliation board operates, the cooperation obligation extends to offering the consumer the possibility of a written settlement in line with the consumer’s request.

Failure to comply with these cooperation obligations falls under the jurisdiction of the consumer protection authority. Following recent legal amendments, in cases of violations by businesses, the imposition of mandatory fines is required, and exemption from fines is not allowed. Relevant provisions of the law on small and medium-sized enterprises (SMEs) have also been amended, so fines cannot be waived even for SMEs.

  • For SMEs, fines may range from HUF 15,000 to HUF 500,000.
  • For non-SME businesses subject to the Accounting Act with annual net revenue exceeding HUF 100 million, fines may range from HUF 15,000 up to 5% of annual net revenue, but not exceeding HUF 500 million.

The introduction of mandatory fines aims to strengthen cooperation with conciliation boards and ensure active participation of businesses in conciliation procedures.

The conciliation board is responsible for resolving consumer disputes outside of court. Its task is to attempt to mediate an agreement between the parties. If mediation fails, the board decides in a way that ensures simple, fast, efficient, and cost-effective enforcement of consumer rights. At the request of the consumer or business, the board may also provide guidance on the rights and obligations of the consumer.

Proceedings before the conciliation board are initiated at the consumer’s request. The request must be submitted in writing to the president of the board. The written requirement can be fulfilled by letter, telegram, telex, fax, or any other means that allows the recipient to store the submitted data in a durable format and reproduce it unchanged for the intended purpose.

The request must include…

  • The consumer’s name, place of residence, or place of stay.
  • The name, registered office, or relevant site of the business involved in the consumer dispute.
  • If the consumer has requested a board other than the competent conciliation board, the name of the requested board.
  • A brief description of the consumer’s position, the supporting facts, and evidence.
  • A statement from the consumer confirming that they have attempted to resolve the dispute directly with the business.
  • A statement from the consumer confirming that no other conciliation proceedings have been initiated, no mediation has taken place, and no claim or payment order has been submitted regarding the dispute.
  • A proposal or request regarding the board’s decision.
  • The consumer’s signature.

The request must be accompanied by any documents or copies (excerpts) the consumer relies on as evidence, in particular any written statement from the business rejecting the complaint. In the absence of such a statement, any other written evidence available to the consumer proving that an attempt at direct resolution was made must be attached.

If the consumer acts through an authorized representative, the authorization must also be attached.

Online Dispute Resolution

The European Commission has established a website where consumers can register, providing them the opportunity to resolve online purchase disputes by submitting a request, thereby avoiding court proceedings. This enables consumers to enforce their rights without being hindered by distance, for example.

If the Buyer wishes to file a complaint regarding a product or service purchased online and does not want to go to court, they may use the online dispute resolution (ODR) tool. On the platform, the Buyer and the trader against whom the complaint is made can jointly select the dispute resolution body to handle the complaint.

Partial Invalidity; Code of Conduct

If any provision of the GTC is legally incomplete or invalid, the remaining provisions of the contract remain in force, and the relevant legal provisions shall apply in place of the invalid or defective part.

The Seller does not have a code of conduct under the law on the prohibition of unfair commercial practices toward consumers.

Correction of Data Entry Errors – Responsibility for Accuracy of Provided Data

The Buyer has the opportunity to modify the entered data before finalizing the order. Providing accurate information is the Buyer’s responsibility at all times. Billing and delivery are based on these data. Please note that an incorrectly provided email address or a full mailbox may prevent the confirmation from being delivered and may obstruct the conclusion of the contract.

If the Buyer discovers an error in the provided data after finalizing the order, they must initiate correction of the order as soon as possible. The Buyer may notify the Seller of an incorrect order by sending an email from the address provided at the time of ordering or by phone.


Use of the Website

The purchase contract is concluded between the Seller and the Buyer. The Service Provider is responsible only for orders placed through the online store at www.sinol.hu, clearly identified with the company logo and data.

The Buyer provides purchase information by filling out the registration form, and the Service Provider fulfills the order and issues an invoice based on this information. The Buyer is solely responsible for any damage resulting from incorrect or false data. The Service Provider is entitled to delete obviously incorrect or false registrations and, in case of doubt, to verify the authenticity of the order.

During registration, the Seller only requests information strictly necessary to process the order. These data will not be shared with third parties, except for information required for the delivery or shipment of the purchased product.

The Purchasing Process

Selecting the Product

The Buyer can select the desired product category by clicking on the product categories displayed on the Website, and within these categories, individual products. By clicking on a product, the Buyer can view the product photo, description, and price.


Adding to Cart

After selecting a product, the Buyer can add one or more items to the cart by clicking the “Add to Cart” button. Adding a product to the cart does not create any purchase or payment obligation, as it does not constitute an offer. For certain products, a minimum quantity that can be added to the cart is defined; this is shown in the “Quantity” column. Any quantity above the minimum can be freely adjusted.

The contents of the cart can be modified freely until the order is finalized. Products can be removed from the cart, additional products can be added, and the desired quantity of each product can be changed.

When the Buyer adds a product to the cart, this is indicated next to the cart icon in the upper right corner of the screen.


Viewing the Cart

During the use of the Website, the Buyer can click on the “Cart” label and icon at any time to check the contents of the cart. Here, products can be removed or quantities adjusted. From this view, the Buyer can navigate to the “Checkout” page, where they can choose to register or purchase without registration and review shipping conditions.

Under “Payment Method,” the Buyer can select whether to pay by bank card, bank transfer in advance, or cash on delivery (COD) with payment to the courier. Afterward, the entered data is reviewed, and the order is submitted.


Providing Customer Data

Here, the Buyer enters the required data, including the option to subscribe to the newsletter. The Buyer provides the delivery address and billing address, and can add any notes for the courier in the “Comments” field.

After filling in and reviewing these fields, the Buyer must accept the “Data Management Policy” and the General Terms and Conditions. By clicking the “Place Order” button, the Buyer finalizes the order and acknowledges that a payment obligation has arisen.

Information provided on the Website does not constitute an offer to conclude a contract by the Seller. Orders placed under these GTC are considered binding only after the completion of the steps above.
